Elossa Fitness Holdings Pty Ltd Privacy Policy. Effective Date 05 November 2023

The Privacy Act 1988 requires entities bound by Australian Privacy Principles to have a privacy policy. The privacy of your personal information is important to us here at Elossa Fitness and we are committed to protecting your personal information and ensuring its privacy and security.

By visiting Elossa Fitness and using any of our products or services and submitting any of your personal information via in-person, phone, website, email or otherwise  –  you agree to and accept your information being collected, stored, used and disclosed as outlined in our Privacy Policy.

This privacy policy outlines Elossa Fitness Holdings Pty Ltd (ACN 669 434 977) privacy principles in accordance with this Act.

1. Collecting Personal Information.

If you are a member, the information gathered will assist us in giving you the best experience possible each time you come into one of our Elossa Studios.

We collect and hold personal information from our members, prospective members, staff, suppliers and other professional associates. The type of personal information that we collect includes:

– Name, address, email address, contact phone numbers, date of birth, emergency contact details, GP contact details, payment details, bank account and/or credit card details, social media account information, health/medical information, membership information, attendance details, and workout information. We may also take photos and videos of you in the Elossa Studio for promotional purposes.

You give permission for Elossa to use any images of you that we have taken at Elossa (for example during circuit sessions or other Elossa events). Only your image will be published, there will be no name published without your express consent. If you do not wish us to use your image, please inform us in writing and we will not do so.

If you are an applicant seeking employment or appointment as a contractor, so that we can assess your suitability.

If you are an employee or contractor, for all purposes relevant to your employment or engagement with us.

Providing your personal information is voluntary, however failing to do so may result in Elossa Fitness being unable to provide you with our products and services and preclude us from dealing with you in any way.

2. How we collect and hold personal information

We will collect personal information directly from you, this information will be collected lawfully and with your consent.

Direct collection

There are quite a few ways we may seek information from you directly. We might collect your information when you fill out an electronic form on our website, sign up to our newsletter, enter one of our competitions, apply for a job with us, telephone us, send us an email or complete a customer survey. We may also take photos and videos of you in the Elossa Studio for promotional purposes.

Social media

Some customers like to engage with us through social media channels. We may collect information about you when you interact with us through these channels.

Email lists

We collect your email address and, if you provide it, other contact details when you subscribe to our email lists. We only use this information to send you our newsletter, regular updates on Elossa and our services, and to administer the lists.

Electronic forms

We use e-forms to enable you to give feedback, make an application or enquiry online via our website.

Collecting through our website and our use of cookies

Where our website allows you to make comments, give feedback or communicate with us, we sometimes collect your email address and sometimes some other contact details. We may use your email address to respond to your comments, feedback or communication.

We might also use cookies (small text files stored in your browser) and other techniques such as web beacons (small, clear picture files used to follow your movements on our website). These collect information that helps us understand how you use our online products and services and how we can make them more relevant to you.

We may use a persistent cookie (a cookie that stays linked to your browser) to record your visits so we can recognise you if you visit our website again. It also lets us to keep track of products or services you view so that, with your consent, we can send you news about them.

We also use cookies to measure traffic patterns, to determine which areas of our website have been visited and to measure transaction patterns in the aggregate. This helps us research our users’ habits so that we can improve our online products and services. You can set your browser so your computer refuses cookies or lets you know each time a website tries to set a cookie.

We may log IP addresses (that is, the electronic addresses of computers connected to the internet) to analyse trends, administer the website, track user movements, and gather broad demographic information.

Indirect collection

In order for us to provide our services, we may collect personal information about you indirectly from third parties such as:

– publicly available sources; or

– your representative, such as an assistant or colleague, an adult relative, a caregiver, who contacts us on your behalf.

Storage of your information

We will take reasonable steps to ensure that the personal information we collect is kept secure. We will put in place reasonable safeguards (physical, electronic and procedural) to secure your personal information.

Your personal information will only be retained for the period of time that is reasonably requited, unless we are required by law to retain it for longer.

At the point in time where we no longer require your personal information we will destroy or de-identify it.

Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.

3. The purposes for which we collect, hold, use and disclose personal information

Elossa Fitness collects your personal information for the purpose of providing our products and services.

This information enables us to:

– provide our products and services to you, including those under your membership agreement

– direct marketing strategies/correspondence to you for the promotion of goods and services that may be of interest to you.

– improve the products and services that we provide by inviting feedback from you

For the safety of people and property inside Elossa Fitness 24-hour CCTV surveillance is recorded live. CCTV coverage is limited to gym floor, reception area, office space and kitchen area. Bathrooms are excluded from CCTV coverage.

Third party service providers

The contact details of our members or other type of business relationships (including our staff, and individuals who work for our clients, suppliers and others) are provided to and may be held offshore, including ‘in the cloud’, by our third-party service providers.

Our third party service providers are currently GymMaster (Treshna Enterprises Gym Management software), Microsoft, Apple and Google (address books and calendars), Xero (accounting information for clients and suppliers), MailChimp (names and email addresses of members and others who are subscribers to our email newsletters), and QuickPay and Paychoice (our 3rd party payment gateway), HUR (our specialised equipment holds you personalised training program), Elossa wrist band (our Elossa membership Access Tag), facebook and Instagram (social media channels), GoDaddy (website hosting), Google analytics (website visitor tracking), Elossa mobile apps (iPhone and Android Apps).

Note that any financial information about members is held and processed on our behalf by QuickPay and Paychoice (our 3rd party payment gateway based in Australia).  We do not know, or have access to, a member’s debit or credit card or bank account information.

If you default in payment of your membership fees, we or our 3rd party payment gateway (Quickpay and Paychoice) may send your outstanding debt and any other relevant information to a third-party debt collection agency to enable them to collect your outstanding fees.

Our eNews and Product News newsletters are mailed to our subscribers on our behalf by MailChimp. MailChimp uses single pixel gifs, also called web beacons, in the newsletters, to create reports for us about which of our subscribers have or have not opened emails or clicked links from a newsletter. You may ‘opt out’ of receiving further marketing and promotional material at any time by either contacting us via email or in writing or where applicable, clicking the ‘Unsubscribe’ button on any marketing communications you receive from us.

We use Google Analytics and Facebook features to measure how many people visit our website, how they found our site (e.g. organic search, clicking on a link from a tweet, or via an ad), which pages on our site they view, and whether they go on to purchase or download one of our products.  This data is not shared with any other third party besides Google technical support (and then only if we require it).  While Google Analytics does not directly identify users, as mentioned above we do collect the name and email address of individuals who download or purchase our products online.

We may use cookies to make the use of our website and services as convenient as possible. Cookies do not directly identify users however they do identify a user’s browser. Most browsers are set-up to accept tracking technologies such as cookies – it is possible to set your browser to refuse tracking technologies however this may limit the services provided to you by our website.

Elossa Fitness may provide links to other external websites. These linked sites are not under the control of Elossa Fitness, and as such we are not responsible for the conduct of companies linked to our website, nor for the performance or otherwise of any content and/or software contained in such external websites.

4. How you may access your personal information that we hold (and seek the correction of such information (if applicable)

You have the right to access your personal information to review, correct or delete the information that we hold. You can request access to your personal information by contacting Elossa. We will provide you with access to your personal information unless otherwise permitted or required by law. If we deny you access, we will notify you of the basis for this denial unless an exception applies.

Deletion of information may result in Elossa Fitness being unable to provide you with certain products or services.

5. Are we likely to disclose your personal information to overseas recipients

Many of our 3rd party service providers are international companies such as GymMaster (based in New Zealand), Google, Facebook, Apple and Mailchimp (USA) etc. These 3rd party companies may have access to your information.

GymMaster (Treshna Enterprises) is based in New Zealand.

Google, Facebook, Apple, MailChimp are based in the USA.

7. Obtaining a copy of our Privacy policy

8. Complaints

If you think that we have breached the Privacy Act or you wish to make a complaint in relation to the collection, storage use or disclosure of your personal information please contact us on the details below. As part of the complaint process you will need to provide us with details of your complaint and any supporting documentation.
